THE PROCESS

EB-5 REQUIREMENTS & TIMELINE

  1. CAPITAL REQUIREMENT

    $800,000 investment in a new commercial enterprise.

  2. BACKGROUND CHECK

    This includes proof that the investor is not a convicted criminal, has no history of financial fraud and has not violated any U.S. immigration laws.

  3. LAWFUL SOURCE OF FUNDS

    Investor must clearly document that their investment capital is from a lawful source, such as:
    • Gifts or loans
    • Income/Savings
    • Business earnings
    • Sale of real estate

  4. "AT RISK" INVESTMENT

    The EB5 investor's capital must be fully invested and the return of that capital cannot be "guaranteed".

  5. FILE I-526E WITH USCIS

    Investor's attorney files 1-526E and adjustment of status concurrently (where applicable)
    with USCIS.

  6. 1-526E PETITION ADJUDICATION

    1-11 months*

  7. 1-526E PETITION APPROVED

    Investor files DS-260 at local
    U.S. consulate or adjustment of status (where applicable) with USCIS.

  8. CONSULAR PROCESSING

    Investor obtains entry visa from local U.S. consulate then must travelto the U.S. within 180 days.

  9. CONDITIONAL U.S. RESIDENCY PERIOD

    Investor is now a conditional permanent U.S. resident and must wait 21 months to apply for removal of conditions (1-829).

  10. 1-829 PETITION REVIEW & APPROVAL

    24 - 30 months*

  11. U.S. PASSPORT
